1. Scope of Services

Mitch's Pretty Awesome Computer Things LLC (“MPACT,” “we,” “us,” or “I”) provides marketing website development services for small businesses. All work is custom and scoped per project based on client needs.

2. Payment Terms

A deposit of 50% of the agreed project fee is due before work begins. The remaining balance is due upon delivery of the final site. For retainer plans, the first retainer month is included at delivery and is due with the final balance. Future retainer payments are due monthly. All payments are processed through a third-party payment processor; we do not directly store or handle payment card information.

3. Revisions and Deliverables

The initial site build includes 2–3 rounds of revisions. For retainer clients, ongoing updates are included within reason. What qualifies as “within reason” is determined at our discretion, but generally covers normal maintenance, content or brand updates, and small feature additions. Large new projects or major redesigns may be quoted separately.

For pay-per-deliverable clients, additional work after the initial deliverable is completed is billed separately at a rate starting at $750 per deliverable, depending on scope.

4. Managed Features

For retainer clients, “managed features” refers to interactive tools that require ongoing backend infrastructure, such as contact forms, booking widgets, and similar. Some managed features are included in the retainer fee. Complex features, high-traffic features, or features requiring third-party integrations may incur additional fees to set up, which will be quoted and agreed upon before implementation.

5. Intellectual Property

Upon full payment, the client owns the final delivered website and its content. We retain the right to showcase the work in our portfolio unless otherwise agreed in writing.

6. Limitation of Liability

We provide services as-is to the best of our ability. We are not liable for indirect, incidental, or consequential damages arising from the use of the delivered site. Our total liability is limited to the amount paid for the services.

7. Cancellation and Refunds

If work has not yet begun, a full refund may be issued. If work is in progress, refunds are prorated based on work completed. Retainer payments are not refundable for the month in which they are paid.
